Information about a possible right of withdrawal
An enquiry does not itself form a contract, authorise building work or waive any rights.
Whether a statutory withdrawal right applies depends in particular on whether you are a consumer, the type of contract and how it is concluded. For covered distance or off-premises consumer contracts, Spanish consumer law generally provides 14 calendar days to withdraw; specified situations, including certain unsolicited home visits or organised sales excursions, may carry 30 calendar days. The start and length of the period must be determined for the particular contract.
There is no unconditional withdrawal right for all construction work. Contracts for construction of new buildings or substantial conversion of existing buildings may fall outside the relevant regime. Statutory exceptions, including expressly requested urgent repair or maintenance work, may apply only to the extent provided by law; extra work is not automatically covered by that exception.
Where a withdrawal right applies, you will receive the required contract-specific information and statutory model form before concluding the contract. You may withdraw by an unequivocal statement to Bauhelden Tenerife S.L., C. Siempreviva 64, 38107 Santa Cruz de Tenerife, Spain, or info@bauhelden.es. Use of a form is not compulsory.
Starting services during the withdrawal period requires your express request and the necessary information where the law requires them. A valid withdrawal after such a start may result in a legally permitted proportionate charge. Loss of the right after full performance depends on the statutory conditions, including the required express consent and acknowledgement. This website does not constitute that consent. Mandatory rights and the consequences of missing or incorrect information remain unaffected.
