General contract terms – draft
1. Scope
These terms provide a basis for individually agreed renovation and building services by Bauhelden Tenerife S.L. They form part of a contract only when validly incorporated before it is concluded. Mandatory consumer rights remain unaffected.
2. Enquiries and contracts
Website content and contact requests are not binding contractual offers or commissions. A contract requires a separate agreement on work and conditions. The accepted quotation and expressly agreed documents determine the scope.
3. Work and variations
Materials, quantities, included work, exclusions and responsibilities are described in the quotation. Additional work and variations are agreed before execution, including effects on cost and timing. Urgent protective measures are governed by the particular agreement and applicable law.
4. Prices and payment
The quotation specifies the price, applicable taxes including IGIC where relevant, payment schedule and any deposits. Additional work requires an appropriate agreement. Merely contacting us does not create a payment obligation for building work.
5. Access, permissions and timing
Required access, available utilities and responsibility for permits and technical assessments are clarified before work starts. Binding dates must be expressly agreed. Either party must promptly notify the other of obstacles; statutory rights concerning delays remain available.
6. Completion and defects
On completion, the work is reviewed together against the agreement and outstanding items are recorded. Statutory defect remedies, applicable warranty and liability rules and any mandatory construction responsibilities remain in force. Inspection or payment does not constitute a blanket waiver of rights.
7. Liability and disputes
Statutory liability rules apply without a general exclusion of consumer rights. Spanish law applies subject to mandatory applicable consumer protections. Mandatory jurisdiction rules, including consumer jurisdiction rights, remain unaffected. Complaints may be sent to info@bauhelden.es.
8. Note
This general draft does not replace project-specific contract terms. Particular construction services and legally required disclosures must be addressed in the relevant contract.
